The milestone was commemorated through a private strategic partnership signing session between Ms Gillian Ooi, Managing Director of ASEAN Records Sdn Bhd, and Mr Jimmy Tham, Appointed Strategic Representative of ASEAN Records Indonesia.

KUALA LUMPUR: ASEAN Records Sdn Bhd menegaskan syarikat itu beroperasi secara sah di Malaysia serta mempunyai kelulusan rasmi daripada Sekretariat ASEAN dan Kerajaan Malaysia untuk menggunakan nama ‘ASEAN’ dalam operasi syarikatnya sebagai platform pensijilan rekod serantau bebas.

Dalam sidang media hari ini, syarikat itu tampil menjelaskan beberapa dakwaan awam berkaitan kedudukan undang-undang, status kelulusan serta operasi komersialnya.

Pengarah dan Ketua Adjudikator Bersama ASEAN Records, Eldrick Koh, berkata syarikat memperoleh kelulusan penggunaan nama ‘ASEAN’ daripada Sekretariat ASEAN menerusi surat rujukan CCAD/LSAD/UNA/2023/Vol.1/014 bertarikh 1 Disember 2023 yang ditandatangani Timbalan Setiausaha Agung ASEAN bagi Hal Ehwal Komuniti dan Korporat, Tran Duc Binh.

Beliau berkata, syarikat itu turut menerima Kelulusan Menteri di bawah Seksyen 27(3) Akta Syarikat 2016 bagi penggunaan perkataan yang diwartakan ‘ASEAN’ dalam nama syarikat menerusi rujukan P/S/2023/A/004396 bertarikh 14 November 2023.

ASEAN Records ialah entiti komersial bebas yang beroperasi dengan kelulusan menggunakan nama ASEAN dan kami tidak pernah menerima sebarang notis pembatalan, penarikan balik atau pindaan terhadap kelulusan berkenaan. “Semua dakwaan yang dilemparkan terhadap syarikat adalah tidak benar dan kami mempunyai dokumen sokongan berkaitan kedudukan undang-undang serta operasi syarikat,” katanya.

Beliau berkata demikian ketika mengulas dakwaan bahawa syarikat itu tidak mempunyai hak menggunakan nama ‘ASEAN’ dan memberi gambaran menerima pengiktirafan rasmi daripada Sekretariat ASEAN.

Koh menegaskan bahawa ASEAN Records tidak pernah mendakwa pensijilan atau pengiktirafan yang dikeluarkan syarikat itu diterbitkan secara rasmi oleh Sekretariat ASEAN.

Sebaliknya, katanya, ASEAN Records berfungsi sebagai platform pensijilan serantau bebas dan bukannya organ, agensi atau wakil rasmi kepada Sekretariat ASEAN.

“Rekod yang dikeluarkan adalah pengiktirafan pencapaian cemerlang di peringkat serantau ASEAN oleh badan bebas dan bukannya dikeluarkan oleh Sekretariat ASEAN sendiri,” katanya.

Mengulas dakwaan bahawa syarikat itu mempromosikan serta menjual anugerah, beliau berkata ASEAN Records ialah syarikat komersial berdaftar di Malaysia yang mengendalikan platform pensijilan berbayar selaras dengan amalan badan pensijilan serantau dan antarabangsa lain.

“Syarikat telah menerima kelulusan sewajarnya di peringkat kebangsaan menerusi Kerajaan Malaysia serta Kementerian Perdagangan Dalam Negeri dan Kos Sara Hidup (KPDN) dan Suruhanjaya Syarikat Malaysia (SSM), selain turut memperoleh kelulusan di peringkat serantau daripada Sekretariat ASEAN untuk beroperasi menggunakan nama ASEAN dalam kapasiti komersial ini.

“Kelulusan pada kedua-dua peringkat ini mencerminkan asas operasi kami yang sah dan telus,” katanya.

ASEAN Records yang dilancarkan secara rasmi pada 14 November 2024 telah mengeluarkan lebih 250 pensijilan rekod ASEAN kepada syarikat, organisasi dan individu di rantau ini.

Ia juga memaklumkan telah menganjurkan sembilan majlis ‘Gather of Achievers’ yang menghimpunkan lebih 1,500 tetamu keseluruhan, selain disertai beberapa pemimpin dan pegawai kanan kerajaan termasuk Timbalan Perdana Menteri, Menteri-Menteri Kabinet dan Yang di-Pertua Negeri Melaka.

Dalam perkembangan sama, Koh berkata syarikat akan mengambil tindakan undang-undang terhadap pihak yang didakwa mengeluarkan kenyataan tidak benar berhubung operasi ASEAN Records.

Katanya, dua laporan polis turut dibuat masing-masing di Balai Polis Kepong dan Ibu Pejabat Polis Daerah (IPD) Cheras pada Ahad lalu berhubung perkara itu.

“Atas nasihat peguam, semua bukti dan dokumen berkaitan akan dikemukakan melalui proses perundangan yang sewajarnya sebaik prosiding dimulakan,” katanya.

KUALA LUMPUR – ASEAN Records Sdn Bhd. (ASEAN Records) menafikan dakwaan bahawa syarikat itu beoperasi tanpa kelulusan dan tidak berdaftar dengan pihak berkuasa adalah tidak benar.

Pengarah Urusannya, Gillian Ooi berkata, ASEAN Records beroperasi sebagai syarikat yang ditubuhkan secara sah di Malaysia dan memegang dua kelulusan bebas bagi penggunaan nama “ASEAN” sebagai platform pensijilan rekod serantau bebas.

Jelasnya, kelulusan pertama adalah daripada Sekretariat ASEAN pada peringkat serantau dan kedua daripada Kerajaan Malaysia pada peringkat kebangsaan.

“Kelulusan ini dikeluarkan di bawah Rujukan CCAD/LSAD/UNA/2023/Vol.1/014 dan bertarikh 1 Disember 2023 yang ditandatangani oleh Tuan Yang Terutama Tran Duc Binh, Timbalan Setiausaha Agung ASEAN bagi Hal Ehwal Komuniti dan Korporat.

“Kelulusan ini telah ditandatangani bersama dengan rasmi dan masih berkuat kuasa sepenuhnya.

“Syarikat juga memegang Kelulusan Menteri daripada Kerajaan Malaysia di bawah Seksyen 27(3) Akta Syarikat 2016 untuk penggunaan perkataan yang diwartakan “ASEAN” dalam nama syarikat (Rujukan P/S/2023/A/004396, bertarikh 14 November 2023),”katanya.

Beliau berkata demikian pada sidang akhbar di Pusat Khidmat Rakyat Parlimen Kepong yang turut dihadiri Pengarah Eksekutif ASEAN Records, Eldrick Koh dan Ketua DAPSY Kepong, Jefferson Chia.

Mengulas lanjut, beliau berkata, kelulusan yang diberikan oleh Sekretariat ASEAN pada Disember 2023 secara khusus membenarkan ASEAN Records menggunakan nama “ASEAN” sebagai identiti korporat dan operasinya sebagai platform pensijilan rekod serantau.

“Kami telah beroperasi secara berterusan dalam skop kelulusan ini sejak pendaftaran, dan tidak menerima sebarang notis pembatalan, penarikan balik, atau pindaan.

“Kami mengiktiraf dan menghormati bahawa Sekretariat ASEAN adalah institusi antara kerajaan serantau. ASEAN Records adalah entiti komersial bebas yang beroperasi di bawah penggunaan rasmi nama ASEAN yang diluluskan. Kami tidak pernah membuat penyataan sebaliknya,”tegasnya.

Sementara itu, Koh berkata, bagi melindungi kepentingan sah syarikat, pemegang rekod kami, dan integriti nama ASEAN diluluskan untuk gunakan, pihaknya akan memulakan tindakan undang-undang yang diperlukan.

Malah kata beliau, dua laporan polis telah dibuat di Kepong dan Cheras pada Ahad lalu berhubung dakwaan tidak berasas sebelum ini.

“Ingin saya tegaskan sekali lagi bahawa syarikat memiliki kelulusan yang diperlukan serta bukti yang menyokong kedudukan undang-undangnya dan operasinya di bawah nama ASEAN.

“Dokumen-dokumen tersebut akan dikemukakan pada masa yang sesuai apabila prosiding undang-undang dimulakan terhadap pihak yang bertanggungjawab,”katanya.

Sebelum ini, media mellaporkan komuniti permiagaan dan perusahaan kecil dan sederhana (PKS), berdepan risiko kerugian besar akibat eksploitasi penjualan sijil dan plak yang didakwa menggunakan nama ‘ASEAN Records’ dengan bayaran mencecah puluhan ribu ringgit.

Perkara itu didedahkan Persatuan Pengguna Semenanjung Malaysia (PPSM) yang memaklumkam kegiatan syarikat swasta yang didakwa mendekati dan mengelirukan PKS supaya membeli pengiktirafan yang disyaki tidak sah itu.

(Kuala Lumpur, 13th) ASEAN Record Sdn Bhd emphasized that the company is authorized by the ASEAN Secretariat and the Malaysian government to use “Asean” as its company name and to operate as an independent record certification platform.

The company’s two executive directors and chief forensic officers, Koo Chun-ming and Wong Tzu-ning, held a press conference today through Kepong DAP Youth Chief Cheah Chee-wei to clarify the allegations made against the company recently.

Huang Zining said that the company holds formal written approval from the ASEAN Secretariat to use the name “ASEAN”, document number CCAD/LSAD/UNA/2023/Vol.1/014, dated December 1, 2023, and signed by ASEAN Deputy Secretary-General for Community and Home Affairs, Chen Deping. The approval letter has been formally countersigned and is still in effect.

She pointed out that the company also obtained Ministerial Approval under Section 27(3) of the Companies Act 2016, which allows it to use the gazetted word “ASEAN” in its company name. The relevant reference document number is P/S/2023/A/004396, dated November 14, 2023.

She emphasized that the company has never made any false statements, and since it was authorized by the ASEAN Secretariat in December 2023 to use “ASEAN” as its corporate identity and operate as a record certification platform, the company has been operating within the scope of the approval and has not received any notification of revocation, termination or modification of the approval.

“We respect the status of the ASEAN Secretariat as a regional intergovernmental body, while we are a commercial entity authorized to operate under the name ‘ASEAN’ and have never made any statements beyond that scope.”

She said that in order to protect the company’s reputation, record holders, and legitimate rights and interests in using the name “ASEAN,” the company will initiate necessary legal action.

“We saw the allegations on Sunday and filed a police report two days ago.”

Also present were members of the company’s legal team, including Dato’ Chang Yu Xiang, Wong Yuen Xuan, Wan Mohd Asong, and Datin Wen Qiao He.

Independent regional record certification platform

Gu Junming said that ASEAN Records Ltd. issues records as an independent regional record certification platform, not as an institution, organization or representative of the ASEAN Secretariat.

“This statement has remained consistent and unchanged in all our promotional materials, award ceremonies, and external communications since our inception.”

He pointed out that the company is an independent platform authorized to use the name “ASEAN” and has a proven track record of outstanding achievements at the ASEAN regional level.

He emphasized that the record was never claimed to have been issued directly by the ASEAN Secretariat.

ASEAN Records is a limited company legally established in our country. It operates as a paid certification platform, which is consistent with mature certification industry practices globally and regionally. Similar to other internationally recognized certification bodies, it conducts commercial operations while maintaining credibility.”

He said the company operates under a dual-approval system, demonstrating its legal and transparent operating foundation.

He pointed out that the recent accusations against the company were untrue.

“Our company holds the necessary approvals and supporting documentation to demonstrate our legal status and operation under the name ASEAN. These documents will be presented in due course after legal proceedings are initiated against the relevant responsible parties.”

He said that since its official launch on November 14, 2024, the company has awarded more than 250 ASEAN-level record certifications, held 9 award ceremonies with a total attendance of more than 1,500 people, and had senior government officials as record witnesses, including the Deputy Prime Minister, ministers, the Governor of Malacca and other senior officials, and has received hundreds of reports from mainstream media.

(Kuala Lumpur, 13th) ASEAN Records Sdn Bhd today issued official approval documents to clarify several recent unfounded allegations questioning its legal status.

ASEAN Records Executive Director and Chief Forensic Officer Wong Tze Ning and Koo Chun Ming, along with their legal team, held a press conference accompanied by Xie Zhiwei, Deputy Chief of the DAP Youth Wing of the Federal Territory of Kuala Lumpur and Chief of the DAP Youth Wing of Kepong.

Huang Zining stated that ASEAN Records received several false accusations questioning its legal status last Sunday (10th) and filed a police report the following day.

She pointed out that as a legally incorporated company in Malaysia, it holds formal written approval from the ASEAN Secretariat, which allows it to use the name “ASEAN” in its company name.

“This approval document, numbered CCAD/LSAD/UNA/2023/Vol.1/014 and dated December 1, 2023, was personally signed by His Excellency Tran Duc Binh, Deputy Secretary-General for ASEAN Community and Corporate Affairs.

“The approval document has been formally signed and remains fully valid.”

She said that ASEAN Records also holds a ministerial approval issued by the Malaysian government under Section 27(3) of the Companies Act 2016, allowing the use of the gazetted word “ASEAN” in the company name, document number P/S/2023/A/004396, dated November 14, 2023.

Furthermore, regarding allegations of false claims of official recognition, certification, or affiliation, Huang Zining pointed out that ASEAN Records has never made any false statements about its status.

She said that the approval granted by the ASEAN Secretariat in December 2023 explicitly allows ASEAN Records to use the name “ASEAN” as the company’s corporate identity and for the operation of the regional record certification platform.

“Our company has been operating within the scope of this approval since its inception, and has not received any notice of revocation, withdrawal or modification.”

She stated that the company respects the status of the ASEAN Secretariat as a regional intergovernmental body, and that it is an independent business entity operating under the formal approval of the name “ASEAN”.

Huang Zining made these remarks at a press conference held this morning at the Kepong Parliament Service Centre.

On the other hand, Gu Junming clarified that ASEAN Records issues records as an independent regional certification platform, and is not an institution, agency or representative of the ASEAN Secretariat.

“This stance has remained consistent and unchanged in all of our company’s promotional materials, award ceremonies, and external communications.”

“The records issued by our company are recognitions of outstanding achievements at the ASEAN regional level, certified by an independent body operating under the official approval of the name ‘ASEAN’. These records do not claim to be issued directly by the ASEAN Secretariat.”

In addition, he pointed out that ASEAN Records is a commercial entity (Sendirian Berhad) legally registered in Malaysia. It operates as a paid certification platform, and its operating model is consistent with mature certification industry practices globally and regionally. Similar to other internationally recognized certification bodies, it conducts commercial operations while maintaining the credibility of the organization.

He reiterated that the ASEAN record has been approved at both the national level (by the Minister of the Companies Commission of Malaysia (SSM) under the Ministry of Domestic Trade and Cost of Living (KPDN)) and the regional level (by the ASEAN Secretariat) to operate as a business entity under the name “ASEAN”.

“The two-tier approval process reflects the company’s legal and transparent operating foundation.”

We are preparing relevant legal documents and will take action against all those involved.

Huang Zining emphasized that the recent accusations against ASEAN Records are all untrue. The company possesses the necessary approval documents, as well as relevant documentary evidence supporting its legal status and operation under the name “ASEAN”.

She said that in order to protect the company, the record holder, and their legitimate rights to use the name “ASEAN,” ASEAN Records will initiate necessary legal action, and will not comment further on the specific details of the relevant litigation proceedings at this time.

“The relevant documents and evidence will be presented at an appropriate time after legal proceedings are initiated against the responsible parties.”

Datin Wen Qiaohe, co-founder of Zhang & Wen Law Firm, pointed out that his legal team has been commissioned to provide legal advice to ASEAN Records, and the relevant legal documents are currently being prepared.

She said that because the incident involves a wide range of issues and a lot of misinformation has appeared in the media and on social media, several investigations are currently underway.

“This press conference is crucial to clarifying the facts. There is no accurate number of people involved at present, but we will take legal action against all those who have been identified as being involved.”

At the same time, Gu Junming expressed his gratitude to the ASEAN record holder, partners, and the many supporters who have trusted the company.

“It is your trust that drives us forward, and we will continue to give our all in accordance with the standards you expect.”

Other attendees included Dato’ Chang Yu Xiang, managing partner of Chang & Wen Solicitors, lawyer Wong Yuen Xuan, and lawyer Wan Mohd Assau.
